this rule safe only because CTS2 has a constraint which will never
allow this to occur. Perhaps the rule should be changed to add the
namespace prefix to one or both child element names when a naming is
detected within a single parent.

The assumption that two elements cannot have the same name from different namespaces is a key to the resulting simplicity. Given the premise that the XML to JSON process is not schema aware, there would be no way to know that a namespace needed to be added unless both elements were present. The alternatives are (a) require that the transformation be schema aware, which is not always possible or (b) to always add namespaces, which makes the rule difficult in order to support the exception.

Note that rule 13 (_CDATA) allows control of embedded XML where the developer doesn't necessarily have full control over the content.
