Should ideally have approval from contributors for the new license moving forward.

If a current goal is to prevent anyone from running off with the nearly complete source code and making a release themselves, I almost wonder if we should hold off on an open source license until the last few tasks for 1.40.8 can be checked off.

You're under no obligation to choose a license. However, without a license, the default copyright laws apply, meaning that you retain all rights to your source code and no one may reproduce, distribute, or create derivative works from your work.

I am not particularly well versed in the legal side of things, but according to this page, nobody is allowed to create or distribute derivative works if there is no license on a repository.

That would be correct for the moment. This PR does not intend to retroactively apply any license changes until it is approved and merged by the primary contributors. Same goes for the CustomJSONData, Tracks, and TracksRS PRs.
